1Club shall not be liable for decisions made based solely on results generated by artificial intelligence tools.
Testing Environment
The client acknowledges that certain implementations, automations, integrations, campaigns, workflows, or developments may require prior technical testing.
During such testing, the implementation process may result in temporary behaviors, duplicate records, test messages, validation events, controlled errors, or non-definitive outcomes.
Such events shall not constitute a breach by 1Club when they are a reasonable part of the configuration, validation, or launch process.
Data and Privacy
Data and Database

In no event shall 1Club’s total cumulative liability exceed the amount actually paid by the client during the three (3) months immediately preceding the event that gives rise to any claim.
Technological Operation
Operational Independence
1Club shall have full autonomy to determine the methods, tools, processes, personnel, technologies, platforms, and resources used in the provision of its services.
The client is contracting for a specific result or service, not for the specific manner in which such service is executed.
Technological Evolution
1Club may modify, substitute, update, or replace tools, providers, platforms, technologies, artificial intelligence systems, methodologies, or internal processes whenever it deems that such changes improve the quality, security, efficiency, or continuity of the service.

Updates to Services and Plans
1Club may modify, update, substitute, add, or remove features, functionalities, tools, integrations, processes, methodologies, or components of its services when necessary for technical, operational, commercial, regulatory, or strategic reasons.

For any dispute arising from these terms, the parties expressly submit to the jurisdiction of the competent courts in León, Guanajuato, Mexico, waiving any other jurisdiction that might otherwise apply to them by reason of their present or future domicile.

Effective Date
These Terms and Conditions enter into force upon their date of publication and shall remain in effect until replaced by a subsequent version.
Additional Operational Provisions
The following provisions supplement 1Club’s General Terms and Conditions of Service and form an integral part thereof.

The assignment of priorities will be determined exclusively by 1Club, taking into account factors such as:
- Operational impact.
- Technical complexity.
- Business risk.
- Resource availability.
- Existing operational workload.
- External dependencies.
- Information security.
Extraordinary Hours
Requests requiring attention outside of standard operating hours—including nights, weekends, holidays, or immediate assistance beyond normal service levels—may incur additional charges.
Where applicable, such charges will be communicated to the client in advance for approval.
Scope Freeze
Once a project, implementation, development, automation, SmartWeb, integration, configuration, or any other service has commenced, the originally approved requirements shall be considered the current scope of the project.
Any substantial change related to:
- Functionalities.
- Design.
- Structure.
- Integrations.
- Workflows.
- Automations.

The acceptance of additional changes shall be at the discretion of 1Club and subject to operational availability.
Client Dependencies
Timelines for execution, implementation, support, development, configuration, training, and delivery may depend on information, access, approvals, validations, materials, content, or decisions that must be provided by the client.
Any delay resulting from a lack of collaboration, response, or timely delivery of such items shall not constitute a breach by 1Club, nor shall it entitle the client to discounts, bonuses, refunds, or compensation.

1Club may reasonably determine when a request exceeds the originally contracted scope.
Out-of-scope requests may:
- Require a new quote.
- Be treated as an independent project.
- Be incorporated into a higher-level plan.
- Require additional consulting hours.
- Require the engagement of specialized services.
Recovery of Suspended Services
If an account remains suspended for more than ninety (90) calendar days, 1Club may consider the account permanently closed.
In such cases, 1Club may delete configurations, automations, backups, integrations, campaigns, websites, digital assets, or associated resources without any liability.
Environments Modified by Third Parties
If the client allows third parties—other than 1Club—to intervene in, modify, or manage platforms, automations, configurations, or systems implemented by 1Club, 1Club shall not be held liable for any failures or issues resulting from such modifications.
Protection of Know-How
